Terms of Service.

The rules for using this website and our free tools. Paid engagements have their own contract.

These Terms of Service ("Terms") govern your use of thinsky.com, the ThinRecon free audit at /audit, and any other free tools or informational content we publish on the same domain (collectively, the "Site"). By using the Site you agree to these Terms. If you do not agree, do not use the Site.

ThinSky Inc. ("ThinSky", "we", "us", "our") is a Canadian corporation headquartered in Toronto, Ontario, with operations in Vancouver and Montreal.

1. What these Terms cover

These Terms cover only the Site and the free tools we publish on it. Paid engagements — including managed security services, compliance readiness, penetration testing, and any custom security work — are governed by a separate signed agreement between you and ThinSky. If a paid engagement contract exists, that contract takes precedence over these Terms for the work it covers.

2. Who can use the Site

The Site is intended for use by adults (18+) acting on behalf of an organisation evaluating cybersecurity services. By using the Site you confirm that you have the legal authority to do so on behalf of any organisation you mention in a form submission.

3. ThinRecon free audit

ThinRecon is a free, non-intrusive external audit. When you submit a domain or hostname for audit, you represent and warrant that:

  • You are authorised by the owner of the domain or hostname to request a security assessment of it.
  • You are not submitting a target you do not have permission to assess. Submitting a third-party target without authorisation may constitute a violation of computer-misuse laws in your jurisdiction (for example, Canada's Criminal Code § 342.1) and is your responsibility, not ours.

ThinRecon performs only externally observable checks against publicly resolvable infrastructure. It does not authenticate to your systems, does not perform credentialed scans, and does not attempt to exploit findings. The report it generates is provided "as is", is informational only, and does not constitute legal, regulatory, compliance, or insurance advice. Acting on the report is at your discretion.

We may rate-limit, throttle, or refuse audit requests at our sole discretion to protect the service and to enforce these Terms.

4. Acceptable use

You agree not to:

  • Probe, scan, or test the vulnerability of the Site, our infrastructure, or any ThinSky-operated system without our prior written consent
  • Attempt to bypass, disable, or interfere with rate limits, honeypots, authentication, or security controls on the Site
  • Submit forms or audit requests using automated means, falsified identities, or other parties' contact information
  • Use the Site to transmit malware, conduct phishing, or commit fraud
  • Scrape, mirror, or republish the Site or its content at scale without our written consent
  • Use the Site in violation of any applicable Canadian, provincial, or foreign law

Authorised security research conducted within the scope of our published responsible-disclosure practice (email security@thinsky.com) is welcome and is not a violation of this section.

5. Intellectual property

The Site, the ThinSky brand, the ThinRecon name, our content, copy, infographics, code, and design system are owned by ThinSky or used under licence. We grant you a limited, non-exclusive, non-transferable, revocable licence to view and read the Site for your own evaluation of our services. We do not grant any rights to copy, modify, redistribute, or create derivative works from the Site beyond what is permitted by Canadian copyright law's fair-dealing provisions.

You retain ownership of any content you submit to us through the contact form or the ThinRecon audit flow. By submitting it you grant us a non-exclusive, royalty-free licence to use it for the purpose of responding to you and delivering the service you requested.

6. No warranty

The Site, the content on it, and the ThinRecon audit are provided "as is" and "as available", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free from harmful components, nor that any audit finding is exhaustive or that the absence of a finding indicates the absence of a vulnerability.

Cybersecurity is a moving target. No tool, including ours, can guarantee that a system is secure. The ThinRecon report is a snapshot, not a certification.

7. Limitation of liability

To the maximum extent permitted by Canadian law, ThinSky and its directors, officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or business opportunities, arising out of or in connection with your use of the Site or reliance on a ThinRecon report. Our total aggregate liability arising from or in connection with these Terms is limited to one hundred Canadian dollars (CA$100).

Nothing in these Terms excludes liability that cannot lawfully be excluded under Canadian consumer-protection or other applicable law.

8. Indemnity

You agree to indemnify and hold ThinSky harmless from any claim, loss, or damages (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your misuse of the Site, or (c) your submission of an audit target you were not authorised to submit.

9. Privacy

Personal information collected through the Site is handled in accordance with our Privacy Policy, which is incorporated into these Terms by reference.

The Site links to third-party tools, services, and infrastructure providers (for example, the open-source projects we operate as managed services). We do not control those third parties and are not responsible for their content, terms, or practices.

11. Changes to the Site or these Terms

We may add, change, or discontinue features, content, or free tools at any time without notice. We may also revise these Terms; the effective date at the top of this page is authoritative. Material changes will be announced on the homepage for at least 30 days. Continued use of the Site after a change takes effect constitutes acceptance of the revised Terms.

12. Termination

We may suspend or terminate your access to the Site or any free tool at our sole discretion, for any reason, including breach of these Terms. Sections that by their nature should survive termination (intellectual property, no warranty, limitation of liability, indemnity, governing law) will survive.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws rules. The courts of Ontario have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Site, and you consent to the personal jurisdiction of those courts.
